Privacy Statement Berghotel The Lounge

Berghotel The Lounge OG located at (6622) Berwang, address Berwang 48, (hereinafter: The Lounge) is responsible for the processing of data as described and referred to in this privacy statement.
The Lounge is engaged in services related to webshops and online marketing. In addition, The Lounge regularly provides supporting services that facilitate the services of its clients. All of this is based, among other things, on agreements for services entered into by The Lounge with its clients. To handle these agreements, it is necessary for The Lounge to process (personal) data.
The data being processed may relate to products and/or companies, but may also include data through which individuals can be identified. This may include, for example, name, address, phone numbers, email addresses, bank account numbers, and similar information.
Without this information, the correct individuals cannot be linked to the relevant assignments, making it impossible for The Lounge to fulfill the agreements properly.
For marketing activities, the programs Google Analytics and Google Ads are used. Data is also processed through these programs. This is based on The Lounge’s legitimate interest in this processing. These programs provide The Lounge the ability to examine how (potential) customers can be approached with existing or new products.
Without the use of these programs, it is not feasible for The Lounge to conduct market research and reach existing and new customers.
When does The Lounge obtain (personal) data
The Lounge obtains these data when a (new) contact initiates communication, whether or not via a quote request from The Lounge, and provides data in the process.
Where necessary, these data will be processed by The Lounge.
Google Analytics
For marketing purposes, The Lounge uses Google Analytics and Google Ads. This allows The Lounge to conduct market research to some extent.
With Google Analytics, it is possible to obtain information such as IP addresses that may lead to the identification of any individual. For this reason, these data also fall under the GDPR.
How long does The Lounge retain data
Under tax law, The Lounge is required to retain data related to assignments for 7 years.
Personal data connected to a collaboration with third parties or a specific client relationship of The Lounge (contact information and correspondence history) are retained as long as the relationship exists. After explicit termination of this relationship, the data will be deleted after 24 months.
Data that are not subject to this retention obligation or do not belong to any collaboration will be deleted within two months of receipt, or anonymized so that they can no longer be traced to a specific individual.
Data obtained through the use of Google Analytics and/or Google Ads will be deleted no later than 50 months after receipt. The Lounge considers this period reasonable, as it needs this time to act on the results of market research and adjust its product range and policies accordingly.
With whom does The Lounge share the data
For proper service delivery and business operations, The Lounge is required to engage third parties.
Regarding business operations
The Lounge uses the services and products of third parties. In addition to using accounting software, an external accountant is consulted, and The Lounge regularly receives leads and assignments via third parties, with data being shared. Internally, The Lounge uses Office 365, an ERP and CRM system, and similar programs for internal and external correspondence and planning.
These parties have (limited) access to the data of The Lounge’s contacts. The Lounge enters into a data processing agreement with these parties to regulate the protection and use of this data.
Other third parties
Without the consent of The Lounge’s contact, no data is shared with other third parties. The only exception is when The Lounge is legally required to do so.
Storage in EEA
Data is stored within the EU, so sharing data with countries outside the EU is not necessary. The exception is data stored by Google on one of its servers outside the EU. For this, The Lounge enters into a data processing agreement with Google.
Without a legal obligation, data will not be shared with companies located outside the EU.
Data security
The Lounge ensures organizational and technical measures to secure (personal) data. This includes, among other things, working with the hosting provider to protect data received through website use, using a good firewall and antivirus software, and, where possible, enabling two-factor authentication for extra login security.
Third-party websites
This privacy statement does not apply to third-party websites linked (or otherwise connected) to The Lounge. The Lounge cannot guarantee that these parties handle (personal) data appropriately. It is recommended to review the privacy statements of these third parties to understand how they handle data.
Your rights regarding the processing and protection of personal data
Under the General Data Protection Regulation (GDPR), you have various rights regarding your personal data. These rights are listed below. Right of access
You have the right to access the data that The Lounge holds about you.
Right to correction, restriction, and deletion
You also have the right to correct, supplement, or delete the data The Lounge holds about you.
Regarding data deletion, The Lounge must comply with the statutory retention period. Data falling under this retention obligation cannot be deleted. All other data will, upon explicit request, be removed from The Lounge’s systems.
You also have the right to restrict the processing of your personal data. This means The Lounge retains your data but does not use it further. This may apply in several cases, e.g., for an upcoming legal process requiring the data. If you believe you are entitled to restrict your data, please contact The Lounge.
Right to data portability
You also have the right to receive the personal data The Lounge holds about you in a machine-readable format, for example, to store or process it in your own or a third-party database.
Right to withdraw consent
